These consist of: the General Terms and Conditions, which cover each of the World of EOS competitions, promotion or program, as well as the specific Terms and Conditions for each competition, promotion or program, so please take note of all the relevant Terms and Conditions that apply to you.
World of EOS General Terms and Conditions – AUSTRALIA/NEW ZEALAND
1.
These terms and conditions govern the Promoter’s use of any entry and other information for any competition, promotion or program on the Promoter’s World of EOS microsite, which is located on a domain belonging to the following URL:

as advised by the Promoter (“Program”) and should be read in conjunction with any other information, terms and conditions for this World of EOS Program.
Eligible Participants
2.
(a) “Eligible Participant” means either the Eligible Entrant or Eligible Voter, whichever is applicable, in this Program. If the Eligible Participant is under 18 years of age, they are required to check with their parents/guardians to ensure they consent to you participating in this Program, its terms and conditions and uploading any Entries.
(b) “Entry” means the submitted work or vote, as defined in the specific World of EOS Program.
Entry Requirements
3.
Each Eligible Participant warrants to the Promoter that: (a) each Entry submitted (including photograph or vote) is their original work that does not infringe the rights of any third party, including but not limited to, copyright, trade marks, trade secrets, privacy, publicity, personal, confidentiality or proprietary rights; (b) the Entry has not been submitted for any other competition, promotions or any other commercial use; (c) they will obtain the consent of any recognisable person (or their parent/guardian, where applicable) that is featured in an Entry to submit the Entry and for it to be used in these terms and conditions; (d) the Entry will not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
4.
Uploaded Entries must be: (a) accompanied by the Eligible Participant's display name, photograph title, and settings (if available); (b) in a high resolution JPEG file no larger than 5MB in size; and (c) of an acceptable resolution and picture quality, as determined by the Promoter in its absolute discretion. Each Entry will be required to meet the specified criteria of the Program to constitute a valid Entry. It is the Eligible Participant's responsibility to make sure that they adhere to the directions given and the Promoter will take no responsibility for any Entries that have been uploaded incorrectly. Eligible Participants are required to retain a copy of any Entries submitted in the highest resolution possible.
5.
The Eligible Participant agrees to indemnify the Promoter against all costs and claims in connection with a failure to comply with these terms and conditions. The Promoter will make best endeavours to uphold any Eligible Participants’ moral rights, however, Eligible Participant consents to any use of their Entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth) or the Copyright Act 1994 (NZ). This includes infringement of their right of attribution for their Entry where Canon deems that it is not reasonable to provide such attribution in the circumstances. For example, Canon may display the Entries for promoting the Program and it may not be appropriate in the overall context of the display to attribute the Eligible Participant.
6.
Each Eligible Participant agrees that they are fully responsible for their Entry they submit. The Promoter is not liable in any way for the Entry to the full extent permitted by law. Each Entry and image will be subject to the approval of the Promoter. The Promoter may remove any Entry or part of an Entry without notice for any reason whatsoever.
Licence Rights
7.
Each Eligible Participant grants the Promoter a non-exclusive, royalty-free, worldwide licence without charge to use, reproduce, publish and display any or all of their Entry or Entries in any of the Promoter’s media or distribution methods (whether now known or later developed), including publication on the Promoter’s website or any internet applications for five years after the end of the associated Program, for any purposes connected with conducting or promoting this Program or the World of EOS.
8.
Each Eligible Participant grants the Promoter the right to request at any time during or reasonably after the associated Program, a non-exclusive licence to use any of their Entries in any media, including publication on the Promoter’s website for five years after the end of the relevant Program for the purposes of promoting its products, services or other promotions, without restriction on use, attribution or liability. These promotions include, but are not limited to, other Canon products and promotions. The Promoter will pay each Eligible Entrant AUD$100 or NZ$100 (as applicable) for each Entry so used, in return for this licence.
Right to request interviews
9.
The Promoter may reasonably request winners and shortlisted Participants to undertake interviews. Winners and shortlisted Participants also provides consent to the Promoter to use their name, likeness, image and or/voice, and the contents of their photo entry and interview (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Program (including any outcome) and/or the World of EOS.
Conditions that may invalidate, disqualify, terminate etc, the Entry, Entrants or the Promotion
10.
Incomplete, indecipherable, or illegible Entries will be deemed invalid. The Promoter reserves the right to disqualify any Entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into. Images that are considered unlawful or contain objectionable content, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain nudity, are watermarked or otherwise objectionable will not be acceptable and deemed invalid.
11.
The use of any automated software or any other mechanical or electronic means that allows a participant to enter, vote or submit Entries repeatedly is prohibited and will render all Entries submitted by that participant invalid. The Promoter reserves the right to determine this in its absolute discretion.
12.
If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Program, as appropriate.
13.
The Promoter reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Program or to be acting in violation of these Terms and Conditions.
14.
Notwithstanding the operation of any other terms herein, the Promoter may terminate the Program as a whole with a minimum of 4 weeks notice, by placing a notice of termination on the Canon or relevant World of EOS website.
Promoter’s Decision
15.
The Promoter’s decision in relation to any aspect of the Program is final and binding on each person who is entered and no correspondence will be entered into. No responsibility is accepted for late, lost or misdirected Entries.
16.
The Promoter reserves the right, at any time, to:
(a)
verify the validity of Entries; and
(b)
verify the Eligible Participant’s personal details (including an Eligible Participant’s identity, age and place of residence).
(c)
disqualify any participant who enters in a way that is not in accordance with these Terms and Conditions or who tampers with the Entry.
Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Privacy
17.
The Promoter collects personal information in order to conduct the Program and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, Australian regulatory authorities. Entry is conditional on providing this information. When joining MyCanon, Eligible Participants may opt in to receive marketing and general information from the Promoter. When joining this Program, you agree to receive emails about your Entry and your participation in the Program, as reasonably determined to be necessary for the operation of this Program by Canon, in its full discretion. Members of MyCanon can access, update or correct their contact information and preferences to the Promoter through their profile page at

. All Entries become the property of the Promoter.
18.
Notwithstanding the above clause 17, the Promoter, its agents or service providers may contact the Eligible Participant in connection to the use of the Entry including any acceptance, rejection or use of the Entry for its purposes.
Liability
19.
Any cost associated with accessing any website is the Eligible Participant's responsibility and is dependent on the Internet service provider and telecommunications provider used.
20.
Liability for any tax on any benefit, if any, provided to a participant in this Program is the sole responsibility of the participant.
21.
Subject to clause 22, in relation to products which are not ordinarily acquired for personal, domestic or household use or consumption and which fail to comply with a consumer guarantee under the Australian Consumer Law, Canon limits its liability to its option of:
(a)
Replacing the products or supplying equivalent products;
(b)
Repairing the products;
(c)
Paying the cost of replacing the products or of acquiring equivalent products; or
(d)
Paying the cost of having the products repaired.
22.
The winner or Eligible Participant may have legal rights, such as the consumer guarantees under the Competition and Consumer Act 2010 (Cth), which may not be excluded or limited under law. Subject to this, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any loss or damage arising in any way out of or in connection with the Program. Examples of such loss include (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry, vote or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Participant; or (f) use of a prize.
Miscellaneous
23.
If any provision of these Terms and Conditions is unenforceable for any reason, such provision shall be severed from these Terms and Conditions and the remaining Terms and Conditions will remain in full force and effect.
24.
These terms and conditions are governed by the laws of New South Wales. The parties submit to the non exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

World of EOS Program Terms and Conditions

The ‘World of EOS General Terms and Conditions’ and information on how to enter and prizes form part of, and should be read in conjunction with these Terms and Conditions for Canon World of EOS Photo 5 Program (“Program”). Any definitions and terms in this Program’s Terms and Conditions shall be given the meaning as set out in the World of EOS General Terms and Conditions. In the event of any inconsistency, the Terms and Conditions of this Photo5 Program will prevail over the World of EOS General Terms and Conditions.
2.
Only Eligible Participants may participate in this Program.
(a)
Eligible Entrants
An Eligible Entrant is an Australian or New Zealand resident who fulfils all of the following criteria: (i) a World of EOS member; (ii) not an employee of the Promoter or any of its affiliated companies or agencies associated with the promotion; (iii) not an immediate family member of an employee as set out in clause 2(a)(ii); and (iv) is not a professional photographer who has earned AU$35,000 or more as an Australian resident or NZ$35,000 or more as a New Zealand resident as a photographer, during the 12 month period immediately preceding the 8/08/2011.
(b)
Eligible Voters
An Eligible Voter is a World of EOS member who is (i) not an employee of the Promoter or any of its affiliated companies or agencies associated with the promotion; and (ii) not an immediate family member of an employee as set out in clause 2(b)(i).
3.
Method of Entry for Eligible Entrants

4. The Program Summary
The Program will consist of:
(a) Five EOS Photo5 Briefs
(b) Portfolio Competition, which is a competition for Entrants who have entered all Five Briefs. Eligible Entrants who have entered all five Briefs will be automatically entered into the Portfolio Competition;
(c) Student Prize Competition which is only open to Method Five Eligible Entrants; and
(d) Voting Competition, as set out in clauses 20 to 24.
5. Upload Process
(a) The “Upload Period” means the period commencing on 05/09/2011 and concludes at
i. EOS Photo5 Brief 2: 13/10/2011 at 12 noon.
ii. EOS Photo5 Brief 3: 17/10/2011 at 12 noon.
iii. EOS Photo5 Brief 4: 19/10/2011 at 12 noon.
iv. EOS Photo5 Brief 5: 21/10/2011 at 12 noon.
v. EOS Photo5 Brief 1 (Open Brief): 24/10/2011 at 12 noon.
(b) To enter a photograph (and any associated information) for the Program (“Entry”), and subject to their specific Method of Entry, during the Upload Period, Eligible Entrants must revisit the Program Website and follow the prompts to the Entry upload page and follow the directions to successfully upload their Entry. Subject to the Promoter’s requirements in clause 10 of the World of EOS General Terms and Conditions, successfully uploaded Entries will be displayed on the Program Website. Entries may be moderated and removed from the Program Website. At this point an “image rejection” email will be sent to the Entrant. The decision to remove an entry is at the Promoter’s absolute discretion and no correspondence shall be entered into.
Entry Specifications
Method One, Method Two, Method Four, Method Five Entrants
6. Method One, Method Two, Method Four and Method Five Eligible Entrants may submit up to five entries, subject to the following:
(a) The Entry must be in line with the details outlined on the Brief section of the Program Website;
(b) Each Eligible Entrant is only permitted to submit a maximum of one Entry for each Brief (i.e. a maximum of 5 Entries per Eligible Entrant, one for each Brief); and
(c) Each Entry must be submitted separately and in accordance with the individual entry requirements.
Method Three Entrants
7. Method Three Eligible Entrants may upload one Entry for the Open Brief, subject to the condition that the Entry, including the uploaded photo, must comply with the details outlined for the Open Brief requirements in the Program Website.
Judging
8. Each Entry will be individually judged based on artistic and creative merit by a panel of judges appointed by the Promoter. The judges’ decision is final and no correspondence will be entered into. This judging process will take place between 25/10/2011 and 08/11/2011. The best 10 Entries for each Brief category and the best 10 sets of five photographs for the EOS Photo5 Brief Portfolio Competition (10 for each EOS Photo5 Brief and 50 for the EOS Photo5 Portfolio Competition, up to 100 in total), as determined by the judges, will become the Finalists. The Finalists' Entries including their display name, comments and image details will be displayed at www.canon.com.au/worldofeos/photo5 and www.canon.co.nz/worldofeos/photo5.
9. In addition, the Promoter will also judge the Method Five Entries as part of a student competition (“Student Competition”) and will select a Winner from the Method Five Entries, based upon the artistic and creative merit.
Voting
10. Eligible Entrants in the Program are automatically eligible to vote. Those individuals who have not registered to enter in the Program must register to vote as set out in clause 2(b) as an Eligible Voter. Eligible Participants can only register to vote on one occasion. Individuals will be declined registration if the same email address has already been registered. Attempts to artificially influence voting in any way will be considered cheating and result in the disqualification of the Entry and/or the Vote.
11. Eligible Voters and Eligible Entrants can vote for the Entry submitted by any Eligible Entrant that they consider to be the best, in (a) each EOS Photo5 Brief; and (b) the Portfolio Competition, by visiting www.canon.com.au/worldofeos/photo5 or www.canon.co.nz/worldofeos/photo5, following the prompts to the voting page and submitting their vote in accordance with the directions during the Public Voting Period.
12. The Public Voting Period is the period commencing on 09/11/2011 and concludes on 29/11/2011 at 12 noon AEDST.
13. Each Eligible Voter and Eligible Entrant can only submit one vote in each Brief and one vote in the Portfolio Competition. For the sake of clarity, Finalists can vote for their own entry, subject to complying with all limitations that apply to voting, including only submitting one vote in each Brief and one vote in the Portfolio Competition.
Winners and Prizes
14. Subject to clause 15, the Entry that receives the most votes at the conclusion of the Voting Period, in each EOS Photo5 Brief and in the Portfolio Competition will be a Winner in that Category. The Entry in the Student Competition will be selected by the Promoter. There will be up to 7 Winners in total from the Eligible Entrants. Winners will be announced on the Program Website on 30/11/11. The Winners will be notified by the Promoter by email or phone within a reasonable time after the judging. The Promoter reserves the right to publish the name, username, photographs, town and state of the winners after the date of the promotion. If the Winners do not wish such details published, they must advise the Promoter within the date specified in the email notification. There may only be one Winner for each category.
15. In the event that two or more Entries receive the equal highest number of votes in a particular Brief, the judge will assess the tied entries and determine a winner, based on artistic and creative merit, in their absolute discretion.
16. In the event where an Eligible Entrant wins:
(a) both the Portfolio Competition and a category Brief, the winner will receive only the prize relating to the Portfolio Competition;
(b) two or more category Briefs, the Eligible Entrant will only receive one prize for the category Brief; or
(c) the Student Competition (if they are a Method Five Entrant) and either the Brief or Portfolio Competition, the Eligible Entrant will only win the prize of the highest value.
17. The five Brief Winners will each receive a prize as outlined below. In the event that the Winner wins more than one Brief, the Portfolio Competition and/or the Student Competition, they will only receive one prize as outlined in clause 16. The prize includes the following:
(a) EOS 5D Mark II Premium Kit (camera body and EF 24-105mm f/4L IS USM lens) (RRP AU$4,499); and
(b) A trip with Jackie Ranken and Mike Langford valued at up to AU$3,070 depending upon point of departure. The trip with Jackie Ranken and Mike Langford includes return economy airfares from winner's nearest capital city (if winner resides in Australia) or from the nearest of either Auckland or Christchurch (if winner resides in New Zealand) to Queenstown NZ, 3 nights accommodation, breakfast daily and a creative photography workshop with Jackie Ranken and Mike Langford. Spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. 18. The EOS Photo5 Portfolio Competition Winner will receive a prize. In the event that the Winner wins a Brief, the Portfolio Competition and/or the Student Competition they will only receive this prize. The prize includes the following:
(a) EOS 5D Mark II Premium Kit (camera body and EF 24-105mm f/4L IS USM lens) (RRP: AU$4,499); and
(b) A Canon PIXMA Pro 9500 Mark II (RRP: AU$1,399); and
(c) An additional Canon EF 8-15mm f/4L Fisheye lens (RRP: AU$1,849)

Voting Competition
20. Eligible Participants who are Australian or New Zealand residents may enter the Voting component of this competition by voting for their favourite photo in one or more of the briefs and answer a 25 words or less the question which will be displayed once an image is voted for (“Question”).
21. Voting entries must include all requested contact details, a vote for an Entry by an Eligible Entrant, and a 25-words-or-less answer for the Question to be eligible to win.
22. The Promoter will select one Voting Winner answer to the Question based on creativity and originality, in their absolute discretion.
23. The competition for the Voter Prizes and voting on the finalist from the five briefs and Portfolio Competition commences on 09/11/11 and concludes at 12 noon AEDST on 29/11/11.
24. Prize: The winner will receive a Canon EOS 7D Super Kit (RRP $2,299).
General Prize Information
25. The winners will be notified by email and the prizes will be sent within 8 weeks of notification.
26. Prize values are accurate at the commencement date of the Program (08/08/2011).
27. If the Promoter is unable to contact the winner to claim fulfilment of the prize by 31/01/2012, or if the winner is unable to attend any element of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the Program. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.
28. In the event that a Winner cannot provide suitable proof as to eligibility or to compliance with any of the applicable Terms and Conditions, as requested by the Promoter, they will not be eligible for the prize.
29. Prizes, or any unused portion of a prize, are not exchangeable, or transferrable and cannot be taken as cash. Prizes will be sent to the winner’s nominated address as confirmed when contacting the winner.
30. It is a condition of taking the prize, that the winner (or if under 18 years of age, their parent or guardian), if requested by the Promoter, sign a legal release in a form determined by the Promoter.
EOS 1WALL
1. The ‘World of EOS General Terms and Conditions’ and information on how to enter and prizes form part of, and should be read in conjunction with these Terms and Conditions for Canon World of EOS 1wall Program (“Program”). Any definitions and terms in this Program’s Terms and Conditions shall be given the meaning as set out in the World of EOS General Terms and Conditions. In the event of any inconsistency, the Terms and Conditions of this 1wall Program will prevail over the World of EOS General Terms and Conditions.
2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. In order to be eligible to enter photos in the promotion, the individual must be an “Eligible Entrant”. An Eligible Entrant is an Australian or New Zealand resident who: (a) is a MyCanon member; (b) is also a World of EOS member; (c) is not an employee of the Promoter or agencies associated with the promotion; (d) is not an immediate family member of an employee as specified in clause 2 (c); and (e) is not a professional photographer who earned AU$35,000 or more as an Australian Resident or NZ$35,000 or more as a New Zealand Resident as part of their profession, during the 13 month period immediately preceding the start of that 1Wall Challenge (regardless of what they may earn after this date).
4. The Eligible Entrant must during the relevant registration period, visit canon.com.au/worldofeos/1wall (Australian residents) or canon.co.nz/worldofeos/1wall (New Zealand residents), follow the prompts to the registration page, and follow the upload prompts including all mandatory information. Each wall will have its own unique URL; for example “/1wall/my-secret-life”.
5. To enter a photograph for the promotion, Eligible Entrants who have successfully registered, must during the Upload Period, re-visit canon.com.au/worldofeos/1wall (Australian residents) or canon.co.nz/worldofeos/1wall (New Zealand residents), follow the prompts to the photograph upload page and follow the directions to successfully upload their photograph. Subject to the Promoter's requirements in Clause 18, successfully uploaded photographs will be displayed on the site. The site itself will exist at canon.com.au/worldofeos/1wall (Australian Residents) or canon.co.nz/worldofeos/1wall (New Zealand Residents). There will only ever be one wall open for submissions at a time and members will be able to submit a maximum of 1 photo per Challenge (as set out in clause 8). Every second month, a new wall/theme for the bimonthly Challenge (“Challenge”) will be announced. Photographers will then be able to submit their entries. Before being published to the site, each image will be subject to the approval of the Promoter. All approved images will be viewable by visitors to the site.
6. An Eligible Entrant may submit only one entry per Challenge subject to the following: (a) the entry, including the uploaded photo, must be in line with the details outlined on the current 1Wall section of the website; (b) each Challenge entry must be submitted separately and in accordance with the entry requirements.
7. Timings and stages that make up the promotion are detailed below. Each entry will be (a) individually judged based on artistic and creative merit by the Judge (Professional Photographer) who sets the theme for that wall and (b) judged by an online vote as set out in clause 12. The Judge’s decision is final and no correspondence will be entered into. There will be 1 Challenge every 2 months - timings can be found below. Eligible Entrants must upload their image within the Upload Periods as specified below.

8. Subject to Clause 18, the entry that is awarded by the Judge and by public vote for each of the Challenges will be the Winners for that Challenge. There will be up to 2 Prize prints per Challenge. In the event that both the Judge and the public vote (“People’s Choice”) award the same image, the Winner will receive only one print of their work. Winners will be announced on the website in accordance with the timings outlined in Clause 8. The Winners will be notified by the Promoter by email within five days from the date the Winner is announced. The Promoter reserves the right to publish the username, photographs and state of the winners once the winners have been announced. The Winners will each receive the Prize. The Prize includes the following: The winning entry printed A2 and either mounted or framed (Winner’s choice) at Foto Riesel Camera House, Sydney. Print will be couriered to the Winner in Australia or New Zealand only. The printed options are Option 1: A2 canvas (mounted, no frame), Option 2: A2 framed (with glass). Prize valued up to $207.25 (as at 22 March 2011).
9. Eligible Entrants who have already successfully registered to enter a photograph in the promotion are automatically eligible to vote. Those individuals who have not registered to enter a photograph in the promotion must register to vote. Individuals need to register in accordance with the stipulated requirements in Clause 11 to vote, during the Voting Periods, to become an Eligible Voter. Eligible Voters can only register to vote on one occasion. Individuals will be declined registration if the same email address has already been registered.
10. An Eligible Voter is an Australian or New Zealand resident who: (a) is a MyCanon member; (b) is also World of EOS member; (c) is not an employee of the Promoter or agencies associated with the promotion; and (d) is not an immediate family member of an employee as specified in clause 2 (c).
11. Eligible Voters can vote for the shortlisted entries that they consider the best, by visiting canon.com.au/worldofeos/1wall or canon.co.nz/worldofeos/1wall, following the prompts to the voting page and submitting their vote in accordance with the directions during the Voting Period.
12. Each Eligible Voter can only submit one vote in each Challenge. For the sake of clarity, those who are shortlisted can vote for their own entry, subject to complying with all limitations that apply to voting, including only submitting one vote in each bimonthly Challenge. The outcome of the voting will determine the People’s Choice winner for that Challenge.
13. In the event that two or more entries receive the equal highest number of votes in a particular Challenge for the People’s Choice, the judge will assess the tied entries and determine a Winner, based on artistic and creative merit, in their absolute discretion.
14. In the event that an Eligible Entrant cannot provide suitable proof of identity, residency and enrolment they will not be eligible for the Prize.
15. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
EOS PHOTOCHAINS
1. The ‘World of EOS General Terms and Conditions’ and information on how to enter and prizes form part of, and should be read in conjunction with these Terms and Conditions for Canon World of EOS Photochains Program (“Program”). Any definitions and terms in this Program’s Terms and Conditions shall be given the meaning as set out in the World of EOS General Terms and Conditions. In the event of any inconsistency, the Terms and Conditions of this Photochains Program will prevail over the World of EOS General Terms and Conditions.
2. DEFINITIONS
i. In these terms and conditions:
"Participant" means a participant in the Program who registers to enter photos in either the Hero Chain, Public Chain or Private Chain components of the Program;
"Program" means the Photochains World of EOS Program;
"Term" means the period commencing on 30.04.2009 and ending when terminated in accordance with these terms and conditions;
"Voter" means a person who votes in connection with the Hero Chain component of the Program in accordance with these terms and conditions;
"Website" means the Program website: www.canon.com.au/worldofeos or canon.co.nz/worldofeos.
ii. By registering, the Participant and Voter accepts these terms and conditions and any rules, policies or procedures that may be adopted by the Promoter from time to time and any changes to these terms and conditions.
iii. Subject to Clause 1.vi and 1.vii, any individual who is a resident of Australia or New Zealand and who completes and submits the online MyCanon registration form may participate as a Participant or Voter in this Program. To become a Participant or Voter, individuals must register by creating a unique login and supply all the details requested to open a MyCanon account. The standard MyCanon terms and conditions apply to each MyCanon account opened. Failure to do so will block the individual from participating as a Participant or Voter. The same email address can only be used once when registering. Any subsequent attempt to register the same email will be declined.
iv. The Promoter, in its absolute discretion, reserves the right to exclude any individual from participating in this Program as a Participant or as a Voter. Employees (and their immediate families) of the Promoter, and the Promoter’s agencies are ineligible. Individuals who are professional photographers who earn $35,000 (AU$35,000 for Australian residents and NZ$35,000 for NZ residents, including any applicable tax and superannuation) or more during the relevant 12 month period are not permitted to participate as a Participant in the Hero Chain component of the Program. This means that a professional photographer is not permitted to enter any photos in a Hero Chain, unless the professional photographer has earned less than $35,000 in the 12 month period immediately before they submit a photo for a Hero Chain (regardless of what they may earn after the date of submitting a photo for a Hero Chain). The Promoter reserves the right to require a Participant to establish that they are not a professional photographer who is ineligible to submit photos for a Hero Chain, and may also request that they sign a statutory declaration confirming compliance with these terms and conditions. Signing a false statutory declaration is a criminal offence.
v. Each individual is only permitted to register once as a Participant and a Voter, unless the Promoter permits otherwise in its absolute discretion.
vi. All times mentioned throughout these terms and conditions are based on Sydney local time.
3. PROGRAM GENERAL OVERVIEW
i. The Program is made up of three (3) components: (a) Hero Chain; (b) Public Chains; and (c) Private Chains.
ii. Hero Chain is a photochain game of skill competition that is open to Participants, excluding some professional photographers (see clause 2.iv for details).
iii. Public Chains are photochains that Participants initiate which other Participants can then be involved in.
iv. Private Chains are photochains that Participants initiate which are only open to Participants who are invited by the relevant Challenger (defined herein).
4. HERO CHAIN
i. Hero Chain is a photochain game of skill competition. There will be a round of the competition ("Round") conducted each 21 day period during the Term, commencing on 30/04/2009, until terminated in accordance with these terms and conditions.
ii. Entries for each Round open on Thursday at 12pm and close Thursday 12pm two (2) weeks after the commencement of the Round ("Entry Period"). There will only be one (1) Hero Chain Link for each Round.
iii. At the commencement of Round One, the Promoter will initiate the Hero Chain by uploading a photo and specifying the Link ("the Hero Chain Link"). The Hero Chain Link is the directions for the link for the photos in the Hero Chain. The Participants have a broad discretion as to how to express the Hero Chain Link in the photo that they wish to upload for the Hero Chain. For example, the Hero Chain Link could be "a bird". A Participant could upload a photo of a bird, or equally acceptable would be a photo of an outline of a bird made in the sand by the Participant. The Promoter in its absolute discretion will determine if the Participant’s photo complies with the Link specified.
iv. Each Participant is only able to enter one (1) photo per Round.
v. To enter a photo for the Hero Chain for a particular Round, the Participant must visit the Website, during the relevant Entry Period, follow the prompts, enter the required details and upload the photo which matches the present Hero Chain Link for the Round, as well as submit the Hero Chain Link that they wish to select for the photo in the next Round if they are declared the winner of this Round. The photo must be in accordance with any format specified on the Website.
vi. In accordance with these terms and conditions, the Promoter may, in its absolute discretion, remove any photo or Hero Chain Link from display on the Website at any stage. In the event that this occurs in connection with the Hero Chain, the Hero Chain will continue despite the removal of a photo from the Hero Chain and the associated competition will continue. If the Hero Chain Link is also removed, the whole photo and Hero Chain Link will be removed but the Hero Chain and the competition will continue the person who submitted a photo or Hero Chain Link that is removed from the Website will not be eligible to receive any prize.
vii. At the conclusion of the relevant Entry Period for a Round at 12 pm on a Thursday, voting will open for 6 days following, i.e. from Thursday 12:01pm on the same day of the closing of the Entry Period to Wednesday 12:00am ("Voting Period").
viii. Once registered, Voters can, during the relevant Voting Period, cast their vote for a photo in a specific Hero Chain by visiting the Website and following the directions.
ix. Only one vote per Voter per Round is permitted. The Promoter accepts no responsibility for how Voters vote. The Promoter reserves the right to declare votes invalid if they do not comply with these terms and conditions or the Promoter reasonably suspects that a Voter is tampering with the voting process.
x. At the conclusion of the Voting Period for a particular Round, the votes will be tallied. The 10 Participants whose photos received the highest number of votes will then be judged by a team of judges and a winner will be declared for that Round. The judges will assess the top 10 photos and determine a winner, based on artistic and creative merit, in their absolute discretion.
xi. The vote count, as determined by the Promoter, is final and no correspondence will be entered into. The winner of each Round, including their display name, comments and photo will be displayed at the Website in the winner section.
xii. The winner of each Round will win an EOS 550D Single IS Lens Kit, consisting of an EOS 550D body and EF-S18-55mm f/3.5-5.6 IS lens worth AUD$1499 RRP or NZD$1899.95 RRP. The prize will only be delivered to an Australian or New Zealand address.
xiii. After the conclusion of the Voting Period for a particular Round, the next Round will commence on the following Thursday.
xiv. Prizes are not transferable or exchangeable and cannot be taken as cash.
xv. The prize value is correct as at 12/04/2010, but subject to change. The Promoter accepts no responsibility for any variation in the value of the prize.
xvi. The Promoter reserves the right to vary the prize, with a prize of equivalent specification and value, in the event that the model of prize is no longer available or a newer model is available.
5. PUBLIC CHAINS
i. There will be no prizes awarded in connection with the Public Chains component of the Program.
ii. Pubic Chains are visible to everyone who enters the Website. There could be multiple numbers of Public Chains at any one time. The Promoter reserves the right to limit the number of Public Chains available.
iii. Individuals who have registered to participate as a Participant may participate in a Public Chain, including any professional photographer.
iv. To commence a Public Chain, a Participant must follow the prompts and upload a photo together with the "Public Chain Link". This person will be deemed the "Challenger". The relevant Public Chain Link is the directions for the link for the next photo in the specified Public Chain. The Participants have a broad discretion as to how to express the Public Chain Link in the photo that they wish to upload for the relevant Public Chain.
v. Once a Challenger commences a Public Chain, other Participants will have a one (1) week upload period (starting from when the first response is submitted and not from when the challenge is set) to enter their photos and their Public Chain Link. The Challenger who commenced the Public Chain will then have one (1) week to select a winning photo from those entered in the previous week to form the next link in the Public Chain. The Promoter may remind the Challenger via email after the upload period expires and 5 days after to select a winning photo for the next link in the Public Chain. The Public Chain Link from the winning photo will form the basis of the Public Chain Link for the next link in the specified Public Chain. The Participant whose photo was selected by the initial Challenger will take over the role of the Challenger and the whole process will start over again, i.e. there will be a one (1) week upload period for Participants to enter their photos. The Challenger will then have one (1) week to select the next winning photo to form the next link in the specified Public Chain. This process will continue until the Public Chain or Program is terminated.
vi. Once the Challenger selects and notifies the Promoter, in accordance with the instructions, which photo is the winning photo, the Promoter will post the winning photo as the next link in the Public Chain, and the next round will begin. If the Challenger fails to select a winning photo within 7 days, the Promoter in its absolute discretion may help to continue the Public Chain and select the winning photo, based on artistic and creative merit.
vii. The Promoter reserves the right at any time, in its absolute discretion, to terminate a Public Chain or remove a photo or photos or Public Chain Link or Links from a Public Chain. If a photo or Public Chain Link is removed from a Public Chain, then the Public Chain will continue with just the photo and/or Public Chain Link removed from display.
viii. Notwithstanding the general right to terminate a Public Chain at any time, the Promoter may terminate a Public Chain in which no one participates for 7 weeks.
6. PRIVATE CHAINS
i. There will be no prizes awarded in connection with the Private Chains component of the Program.
ii. Private Chains will be visible to everyone who enters the Website. There could be multiple numbers of Private Chains at anyone time. The Promoter reserves the right to limit the number of Private Chains available.
iii. Individuals who have registered to participate as a Participant may participate in a Private Chain, including any professional photographer, provided they are invited by the Private Chain’s Challenger.
iv. To commence a Private Chain, a Participant must follow the prompts and upload a photo together with the "Private Chain Link". This person will be deemed the "Challenger". The relevant Private Chain Link is the directions for the link for the next photo in the specified Private Chain. The Participants who are invited to participate by the Challenger have a broad discretion as to how to express the Private Chain Link in the photo that they wish to upload for the relevant Private Chain. The Private Chain differs from a Public Chain, as only people who are invited by the Challenger may participate, provided these people also register to become a Participant.
v. Once a Challenger commences a Private Chain, other Participants who were invited by the Challenger will have a one (1) week upload period (starting from when the first response is submitted and not from when the challenge is set) to enter their photos and their Private Chain Link. The Challenger who commenced the Private Chain will then have one (1) week to select a winning photo from those entered in the previous week to form the next link in the Private Chain. viii. Notwithstanding the general right to terminate a Private Chain at any time, the Promoter may terminate a Private Chain in which no one participates for 7 weeks.
7. GENERAL
As part of the Program the Promoter may give Participants the ability to refer the Program to other individuals by email, including when Challengers of Private Chains wish to invite people to submit photos for the Private Chains. The Participants warrant that they will only refer people who would consent to receiving such emails, and will only refer people who would also be eligible to participate in the Program.
8. PRIVACY
Each Participant also agrees to receive communications about the Program, by email or other means, while they remain a Participant. If they do not agree to this they will be ineligible to participate.
EOS INSPIRES
1.
The ‘World of EOS General Terms and Conditions’ and information on how to enter and prizes form part of, and should be read in conjunction with these Terms and Conditions for Canon EOS Inspires Program (“Program”). Any definitions and terms in this Program’s Terms and Conditions shall be given the meaning as set out in the World of EOS General Terms and Conditions. In the event of any inconsistency, the Terms and Conditions of this EOS Inspires Program will prevail over the World of EOS General Terms and Conditions.

Both Eligible Entrants and Eligible Voters may participate in this Program. There are two components to this competition: a voting and photography competition. An Eligible Entrant is an Australian resident who: (a) is a World of EOS member; (b) is not an employee of the Promoter or agencies associated with the Program (c) is not an immediate family member of an employee as specified in clause 2 (b); and (d) is not a professional photographer who earned AU$35,000 or more during the 12 month period immediately preceding 14/11/2011(regardless of what they may earn after this date). An Eligible Voter is an Australian resident with a Facebook account.

There are three prizes: the Judge’s Choice Award prize comprising a Canon EOS 5D Mark II Premium Kit, valued at $4299; the People’s Choice Award prize comprising a Canon EOS 5D Mark II Premium Kit, valued at $4299; and the Voting Prize Award comprising a Canon EOS 7D Super Kit, valued at $2699.

To enter the Program Eligible Participants must, during the Promotional Period, visit the Facebook Platform and submit their details (name, email address) and a vote or photograph taken by them (as applicable) to the “EOS Inspires” application on the Facebook Platform by either visiting (www.canon.com.au/eosinspires), which is only visible if the entrant likes the Canon EOS Australia Page or the “EOS Inspires” tab on the Canon EOS Australia Page on Facebook (http://www.facebook.com/CanonAustralia) (“Promotional Website”). It is each Eligible Participant's responsibility to adhere to the requirements of the Terms and Conditions, the prevailing terms and conditions of the Facebook and the Promoter’s websites respectively and the Promoter will take no responsibility for any Entry( whether a vote or photograph) that has been uploaded incorrectly.

The Program starts at 12:01am on 14 November 2011 and ends at 08:59am Australian Eastern Standard Time on 28 November 2011, (“Promotional Period”). The Promoter reserves the right to extend the Promotional Period at its discretion. Only those entries that are received during the Promotional Period will be considered.
6.
Eligible Entrants may only enter one photograph in the Program. The theme of the competition is available on the EOS Inspires application on the Promotional Website and the photograph must depict the theme using any photographic technique to be considered an Eligible Entry. This will be determined in the sole discretion of the Promoter and no further correspondence will be entered into.
7.
Each Entry (photograph and any accompanying text) that is submitted will be reviewed by the Promoter to determine its suitability in accordance with the requirements of these Terms and Conditions. Those photographs (and any accompanying text) that are approved by the Promoter (“Entry”) will be displayed on the Promotional Website and will be viewable by visitors to the site.
8.
Visitors to the Promotional Website will, by following instructions contained in the website, be able to vote for the Entry of their choice. Each visitor, as well as Eligible Entrants may only vote once in the Program. Voting will be open from 09:00am on 28 November 2011 and will cease at 08:59am on 2 December 2011 (“the Voting Period”).

The Eligible Entrant whose Entry has received the most votes by the close of the Voting Period will be declared the People’s Choice Award Winner. In the event of a draw those Entries with the most votes will be judged by the Promoter and the Eligible Entrant whose Entry is deemed to have the highest artistic and creative merit will be declared the People’s Choice Winner and will be awarded the Prize. The Promoter will remove entries if an Entrant has submitted more than one photograph. Each entry will be individually judged based on artistic and creative merit. The Canon Judge -- appointed by the Promoter as being suitably qualified -- will select based on artistic and creative merit the Winner of the Canon Judge’s Award. The People’s Choice Winner and the Canon Judge’s Award Winner could be the same Entry. The judge’s decision is final and no correspondence will be entered into. This judging process will take place between 2 December and 5 December 2011.
10.
Voters may enter the Voting competition by answering a 25 words-or-less question, as set out on the Promotional Website during the Voting Period. The Promoter will then select the most creative and original answer, as determined in its sole discretion. The Voter who provided the most creative and original answer will be the Winner of the Voting Prize Award.
11.
An Eligible Participant may win more than one award but may only receive the higher valued Prize.
12.
The Winners will be notified by email prior to the broadcast on Monday 5 December 2011. The winners will be announced on Channel 7’s Sunrise (http://au.tv.yahoo.com/sunrise) on Monday 5 December 2011. The winners of the photography component will also be announced on the Canon EOS Australia Page on Facebook (http://www.facebook.com/CanonAustralia). The Promoter reserves the right to publish the Winner’s name, Entry, town and state.
13.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Participants (including an Eligible Participant's identity, age and place of residence) and to disqualify any Eligible Participant who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to request Eligible Participants provide proof of identity, residency, and age. Eligible Entrants are required to retain a copy of their submitted photograph in the highest resolution possible. Proof considered suitable for verification is at the discretion of the Promoter.

The Promoter may contact the Eligible Entrant at any time during or reasonably after the Program to request for a licence to use and display their Entry for purposes outside those outlined in clause 12. Each Eligible Entrant warrants that they will have the full authority to grant these rights.

Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users. All entries are subject to the www.facebook.com website prevailing terms and conditions of use (available at http://www.facebook.com/promotions_guidelines.php). The Promoter may delete any content posted on its site (including, but not limited to the Canon EOS Australia Facebook Page) in accordance with the Promoter’s prevailing terms and conditions of use of its site. Any entries that are removed by the Promoter will not be considered Eligible Entries for the purposes of this Program.

Participants release Facebook from any liability as a result of this Promotion. The information so provided will only be used for the purposes of the Promotion and as detailed in these Terms and Conditions. Facebook is not responsible for providing any information regarding questions, comments or complaints regarding the Program. Please direct all correspondence to the Promoter. Any linking to Facebook or its associated applications within this Program is provided for the convenience of participants. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification.

The Prize is not transferable or exchangeable and cannot be taken as cash.

In the event the Winners do not claim their Prize by the date stipulated in the Promoter’s notification email, the Winner forfeits their Prize. The Promoter may then select another Winner to award the Prize based on the original criteria. The Promoter’s decision is final and no correspondence will be entered into.
