Canon Australia "PIXMA Online Demonstration" Terms and Conditions

1. Canon provides the PIXMA Online Demonstration ("Sample Offer") to you on the basis of the following terms and conditions ("Terms and Conditions"). These Terms and Conditions may be updated by Canon from time to time by uploading such revised Terms and Conditions on the Canon website without prior separate notification to you. You should check the Terms and Conditions each time you access the website in order to check for any possible update. Any subsequent access shall constitute acceptance of the Terms and Conditions so changed.

2. Eligibility: Sample Offer is only open to individuals who have an Australian mailing address. Employees and their immediate families of Canon, and their outlets and agencies that are associated with this promotion are ineligible.

3. Entry instructions: Consumers may, under the Sample Offer, obtain a maximum of two free print samples ("Sample Prints") delivered to their nominated Australian address. Sample Print(s) provided can be either the consumer's printed off version of his or her uploaded image(s), or selected from the Canon Sample images provided online, depending upon the consumer's choice. To claim their Sample Print, a consumer must correctly complete the online redemption form, and upload one image or select from the sample images provided (following instructions available within the 'upload image page' functionality) during the Promotional Period. Consumers may repeat this process for a maximum of two Sample Prints per registered user. Images which do not meet the upload specifications, will not be processed.

4. Limitation: Only two free Sample Prints per registered user.

5. Duration: The offer commences Thursday 1st November 2007 and ends at Midnight AEDST Monday 30 June 2008. ("Promotional Period").

6. Sample Details: Sample Prints cannot be taken as cash, are not transferable or exchangeable. Please allow approximately14 working days for delivery.

7. Late Submissions: No responsibility is accepted for late, lost, incorrectly formatted or misdirected submissions.

8. Your Warranties: You undertake not to submit any materials that are or could reasonably be construed as: (i) defamatory, libelous, obscene, offensive, abusive, liable to incite racial hatred, discriminatory or blasphemous; (ii) in breach of any obligation of confidence or privacy or any trade secret; (iii) infringing the proprietary rights of any third party or for which you have not obtained all necessary licences and/or approvals; or (iv) violating any other law. You also agree not to transmit to Canon any materials which could reasonably be held to constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of any country or other competent authority, or infringe the rights of any third party enforceable in any part of the world. You agree to indemnify Canon and Canon affiliates against any claim, demand, loss or damage suffered as a result of breach of your warranties.

9. Liability: Canon shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of participating in this Sample Offer, except for any liability which cannot be excluded by law.

10. Right of Rejection: Canon reserves the right to remove any materials from the PIXMA Online Demonstration, where it reasonably suspects that such materials are prohibited by these Terms and Conditions or are otherwise inappropriate.

11. Monitoring of Content: Canon will vet the images provided in line with the terms and conditions ("Terms and Conditions") however all images provided by a user of this service are the sole responsibility of that user, not Canon.

12. Privacy: Canon requires claimant's personal information in order to conduct the Sample Offer. The personal information may be disclosed to third parties for the purpose of supplying the Sample Offer. By making a claim for a Sample Print, unless otherwise advised by the claimant, each claimant consents to the information they submit with their claim being entered into a database and Canon may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the claimant, including sending electronic messages or calling the claimant.
