TERMS AND CONDITIONS
1. Participation in this Canon Australia Photo Marathon Competition (Competition) is deemed acceptance of these Terms. Information and instructions on how to participate form part of these Terms.
2. This Competition starts at 9:00am AEST on 19 September 2026 and ends at 9.00pm AEST on 21 September 2026 (Competition Period).
Eligible Participants
3. The Competition is only open to individual Australian residents aged 18 and above who:
a. are members of the official Canon Collective Facebook Group (Facebook Group); and
b. are not employees (or their immediate family members) of Canon or its related bodies corporate (Participants).
How to Enter
4. At 7.00pm AEST on 18 September 2026, the Promoter will announce the Competition and the following 18 briefs on the Facebook Group:
a. The Decisive Moment – Capture a split second when timing makes the photograph.
b. Hidden in Plain Sight – Reveal something interesting that people regularly overlook.
c. Human Touch – Show how people shape, alter, care for or leave their mark on the world.
d. Between the Lines – Create an image whose real story lies beyond what is immediately visible.
e. Against the Grain - Photograph someone or something that challenges convention or moves in a different direction.
f. Open Brief: This is Me - Create an image that reflects your interests, personality or your unique way of seeing the world.
(Mandatory Briefs),
g. No Faces - Create a compelling portrait or human story without showing a recognisable face.
h. The Space Between – Use distance, negative space or separation as an important part of your composition.
i. Made by Hand – Celebrate craftsmanship, creativity, work or the beauty of something handmade.
j. Unexpected Light – Find light appearing in an unusual place or use it in a surprising way.
k. Local Character – Capture a person, place or detail that expresses the personality of your community.
l. Out of Place – Find something that clearly does not belong – or make it appear that way.
m. Passing Through – Interpret travel, transition, temporary encounters or the movement from one place to another.
n. Perfectly Imperfect – Celebrate flaws, age, wear, individuality or beautiful irregularities.
o. Sound of Silence – Create a photograph that communicates stillness, solitude or calm.
p. Scale – Play with size, perspective or the relationship between something large and something small.
q. What Happens Next? – Capture a moment that makes the viewer anticipate the next part of the story.
r. A Different Point of View – Change your position, angle or perspective to show a familiar subject in a new way. (Additional Briefs),
(referred to collectively as the Briefs).
5. To enter this Competition and be eligible to be selected to win a Minor Prize (Minor Prize Entry), Participants must, within the Competition Period:
a. submit their image to the Facebook Group that meets any Mandatory or Additional Brief.
6. To enter this Competition and be eligible to win the Major Prize (Major Prize Entry), Participants must submit 12 images to the Facebook Group within the Competition Period. Each Major Prize Entry must include:
a. 6 images that meet 6 distinct Mandatory Briefs; and
b. 6 images that meet 6 distinct Additional Briefs.
7. Entries can only submit one unique image per Brief.
8. Entries will only be accepted by the Promoter if the Participant submits the image(s) as a comment on the Promoter’s post announcing the Competition in the Facebook Group during the Competition Period.
9. All images in an Entry must be taken by the Participant with a camera during the Competition Period. Images created prior to the Competition Period are not allowed, and Canon reserves the right to ask Participant for a copy of the original file.
10. If any Entry contains a person (including a person under the age of 16), people (including any talent) or third party and a legal release is required so that the Promoter can use the image in the manner disclosed within these Terms without liability or cost to the Promoter, Participants must obtain and keep a properly executed release or consent signed by the relevant person (or people) (including from their parent or guardian if the person is under the age of 16). Participants may be required to produce such releases and written consent to the Promoter at their request and/or as a condition of claiming the Prize.
11. No part of an Entry can contain any content generated by an AI tool. Entries that have been altered using an AI tool to create new content or element(s) that are not present in the original image captured by the Participant’s camera will be disqualified. AI tools can only be used for the purpose or extent of editing, enhancing or removing elements of the original image (such as for colour grading, blurring or removing a background) where the integrity, content and context of the original photograph is maintained.
12. By participating in this Competition and uploading any photos, Participants declare that they are the owner of that media. Participants warrant they have necessary rights to use any photo, uploaded or otherwise used in connection with this Competition, and that any use by Canon of the photo, video or other media does not infringe upon the rights of any third-party.
13. By submitting an Entry, Participants will retain any copyright they own. Participants grant Canon a perpetual, irrevocable, non-transferrable, non-exclusive licence to use and publish the media for internal use and for promotion on Canon ANZ’s Facebook, Instagram or TikTok, and website, without further permissions. The Promoter agrees to attribute the Participants by their Facebook username. Participants agree that this is sufficient attribution.
14. Only 1 Minor Prize Entry and 1 Major Prize Entry is permitted per Participant. All Entries must be received by the Promoter within the Competition Period.
Moderation
15. Entries are subject to moderation. The Promoter reserves the right (in its sole discretion) to take down and exclude from the judging any Entry which the Promoter considers:
a. breaches Canon ANZ’s Instagram and Facebook Community Guidelines set out at Community Guidelines;
b. breaches Facebook’s Community Guidelines;
c. was generated utilising generative artificial intelligence technology;
d. is otherwise not in accordance with these Terms.
16. Entries must be of an acceptable resolution and picture quality, as determined by the Promoter in its absolute discretion. Participants are required to retain and provide the Promoter, at its request, a copy of any Entries submitted in the highest resolution possible.
Judging
17. This Competition is a game of skill. Administrators of the Facebook Group will judge each Entry based on creative merit and how well it meets the Briefs.
18. The judges will select 19 winners in this Competition who will each receive a Prize (Winners).
a. 1 Minor Prize Entry will be selected from each Brief category and awarded a Minor Prize (Minor Prize Winners). There will be 18 Minor Prize Winners.
b. 1 Major Prize Entry will be selected and awarded the Major Prize (Major Prize Winner).
19. The judges’ decision is final and no correspondence will be entered into.
20. The Promoter does not accept any responsibility for any Entry that is late, lost or misdirected, or if the Winner does not claim their Prize in accordance with these terms.
Prize
21. Each Minor Prize Winner will (at the Promoter’s discretion) receive one Canon Merchandise item (valued individually at the minimum of $22.95 RRP) (Minor Prize).
22. The Major Prize Winner will receive 1 x Canon EOS R8 Mk II Body + RF 24-50mm lens (valued at $2,809.00 RRP (Major Prize).
23. The total Prize pool is $3,084.40 including GST. For clarity, each Winner can only win 1 Prize. If a Participant wins the Major Prize, they will not be eligible to win any Minor Prize. If a Participant wins a Minor Prize, they will not be eligible to win another Minor Prize.
24. The Promoter has the right to replace all or part of the Prize with another item of similar value in their absolute discretion if for any reason the Prize is not available.
Claiming the Prize
25. The Winners will be announced on the Facebook Group on 29 September 2026. Winners must contact the Promoter via [email protected] with their full name, phone number and postal address in order to claim their Prize. The Promoter will first judge the Major Prize Entries against the criteria outlined in these Terms and Conditions and announce the Winner of the Major Prize. The Promoter will then judge the Minor Prize Entries against the criteria outlined in these Terms and Conditions and announce the Minor Prize Winners.
26. If a Winner:
a. does not claim their Prize according to the instructions stated in clause 25, or otherwise advised by the Promoter; or
b. does not claim their Prize by 6 October 2026; or
c. cannot provide suitable proof as to their eligibility or compliance with these Terms,
they will forfeit the Prize in its entirety, and the Promoter will choose an alternate winner by from the rest of the Entries at their sole discretion.
27. The Prize or any unused portion of the Prize is not exchangeable or transferrable. The Promoter will not compensate any Participant in any way for Prizes that have not been claimed within the time limits.
28. It is a condition of claiming the Prize that if the Winner's Entry was posted by their social media account, the Winner must, if requested by the Promoter, provide proof the Winner owns and controls that social media account.
Participant’s Warranties and Indemnity
29. Each Participant warrants to the Promoter that:
a. their submissions are their own original images that do not infringe on any copyright or privacy laws, or rights of any third party; including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal, confidentiality or proprietary rights;
b. their Entry has not been submitted for any other competition, promotions or any other commercial use
c. they have complied with the Entry requirements;
d. no Entry submitted by them will contain viruses or cause injury or harm to any person or entity; and
e. in relation to their Entry, they have and will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
30. Each Participant agrees to indemnify the Promoter against all costs and claims in connection with a failure by them to comply with these Terms.
31. Each Participant agrees that they are fully responsible for each Entry they submit, and is fully responsible for any equipment, materials, licences, or other costs required for or associated with each such Entry. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.
32. This Competition is in no way endorsed, sponsored or affiliated with Facebook. Each Participant agrees to indemnify Facebook against all costs and claims arising in connection with a failure by them to comply with these Terms, or otherwise arising in connection with this Competition.
33. By accepting these Terms, the Participants confirm they have reviewed and accepted the policies, terms and conditions of Facebook.
34. By entering this competition, the Participant grants Canon the perpetual right to use their Entry in marketing activities across the Promoter’s digital channels including social media and their websites.
35. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.
Conditions that may Invalidate Entries, Participants or the Competition
36. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. to disqualify any Participant; or
b. to modify, suspend, terminate or cancel the Competition as appropriate.
37. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.
38. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Privacy
39. The Promoter collects personal information to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
40. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (available at www.canon.com.au/Privacy-Policy for Australian residents), which contains information about access, correction and complaint processes.
Copyright
41. In addition to any rights that may be granted by a Participant in accordance with the terms and conditions of Facebook, by submitting an Entry, Participants hereby grant the Promoter permission to publish any of their Entries (including Facebook handle) on Canon ANZ’s Instagram, Facebook and TikTok. The Promoter agrees to attribute the Participants by their Facebook username.
Liability
42. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
43. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Participant; or (e) use of the Prize.
General
44. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.
45. All money amounts in these Terms are in Australian Dollars inclusive of GST.
46. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.
47. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
