Canon Australia – Photo Marathon 2022 (Competition)


TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this Competition is deemed acceptance of these Terms and Conditions.

2. The Promoter is Canon Australia Pty Ltd (ABN 66 005 002 951) of Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW, 2113, Australia (Phone: 13 23 53) (Canon).


Eligible Participants and Registrations

3. This Competition is only open to individual Australian residents aged 18 and above who are members of the Canon Collective Facebook Group and are not employees (or their immediate family members) of Canon or its related bodies corporate (Eligible Participants).


How to Enter

4. There will be a total of 12 Entry Periods (12 Briefs) throughout the competition as follows. Each brief will be announced on the Canon Collective Facebook Group:

Winners and Prizes

5. A winning image from each Brief will be announced on the group on 7 May 2022.

6. The winners must then contact Canon Australia via stories@canon.com.au with their full name, phone number and address so that Canon can send their prize packs or voucher code to them.

7. There are 13 prizes to be won. Of the 13 prizes available, 12 of these will be ‘Minor Prizes’ which consist of a Canon prize pack.

The Canon prize pack consists of a Canon branded photo frame, Canon notebook, Canon pen, Canon lanyard and Canon tote bag. Prize packs will be sent to the winner’s nominated address by Australia Post standard parcel delivery. The Promoter is not responsible and has no liability (including for negligence) for any losses or claims related to incorrect, delayed, damaged or lost deliveries.

There will be 1 x Major Prize which consists of a $300 voucher to use at CameraPro. The voucher will be delivered to the winner of the Major Prize in the form of a code that can be used instore at any Camera Pro retail store or online.

8. Prizes, or any unused portion of a prize, are not exchangeable, or transferrable and cannot be taken as cash.

9. It is a condition of taking the prize that the winner will, if requested by the Promoter, sign a legal release in a form determined by the Promoter.


Entry Requirements

10. An “Entry” means each set of images submitted to the Canon Collective Facebook group page during the relevant Entry Period, in accordance with these terms and conditions and the requirements of the relevant Brief specified in clause 4, and any other express instructions communicated by the Promoter.

11. To submit a valid Entry to this Competition, Eligible Participants must submit their images on the Canon Collective Facebook Group page. Entries must be submitted between the brief being posted on 30 April 2022 and 12:00pm AEST, 1st May 2022.

12. Entries must be:

• taken using a Canon digital camera only;
• posted on the Canon Collective Facebook Page in the same Facebook post comment thread where the brief is announced.
• created during the challenge period. Images created prior to the brief being announced are not allowed, and the Promoter reserves the right to ask Eligible Participants for a copy of the original file.

13. Each Eligible Participant warrants to the Promoter that:

(a) each Entry submitted is their original work that does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal, confidentiality or proprietary rights;

(b) the Entry has not been submitted for any other competition, promotions or any other commercial use;

(c) they will obtain the consent of any recognisable person (or their parent/guardian, where applicable) that is featured in an Entry to submit the Entry and for it to be used in conjunction with these terms and conditions;

(d) the Entry will not contain viruses or cause injury or harm to any person or entity; and

(e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation and privacy.

14. Each Entry will be required to meet the specified criteria of the relevant Brief to constitute a valid Entry. It is the Eligible Participant's responsibility to make sure that they adhere to the instructions for each brief.

15. Entries must be of an acceptable resolution and picture quality, as determined by the Promoter in its absolute discretion. Eligible Participants are required to retain a copy of any Entries submitted in the highest resolution possible.

16. Each Eligible Participant will be permitted to make only one submission per brief. Eligible Participants may make one submission to all 12 briefs, however there is no requirement to enter all 12. To be entered Minimum number is at least 1 brief.

17. By submitting an Entry, Eligible Participants will retain any copyright they own. The participant grants Canon Australia Pty Ltd a perpetual, irrevocable, non-transferrable, non-exclusive licence to use their submissions to this Competition for internal use and for promotion via Canon Australia’s social media accounts and website. If the Promoter wishes to use an Eligible Participant’s Entry, the Promoter agrees to attribute the Eligible Participant by Facebook username. Participants agree that this is sufficient attribution.

18. The Eligible Participant agrees to indemnify the Promoter against all costs and claims in connection with a failure to comply with these terms and conditions.

19. Each Eligible Participant agrees that they are fully responsible for their Entry they submit, and are fully responsible for any equipment, materials, licenses or other costs required for or associated with their Entry. The Promoter is not liable in any way for the Entry or any costs borne by the Eligible Participant relating to the Entry, to the full extent permitted by law.

20. Each Entry and image will be subject to the approval of the Promoter. The Promoter may remove any Entry or part of an Entry without notice for any reason whatsoever.


Judging

21. Each Entry will be individually judged based on artistic and creative merit, and on the Entry that best fits the brief, by the administrators of the Canon Collective Facebook Group. The judges’ decision will be made in their absolute discretion, is final and no correspondence will be entered into. The judging process will take place at various intervals during the relevant Entry Period and following the closing time for the submission of each brief. There will be one winner awarded for each brief.

22. Late or incomplete Entries will not be accepted.


Conditions that may invalidate, disqualify, terminate etc, the Entry, Eligible Participants or this Competition

23. The Promoter reserves the right to disqualify any Entry where: it reasonably suspects that such materials are prohibited by these Terms and Conditions or any relevant law; it is deemed inappropriate; or is otherwise rejected by the Promoter. This right may be exercised at the Promoter's absolute discretion and discussions will not be entered into. Images that are considered unlawful or contain objectionable content, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain nudity, are watermarked or otherwise objectionable will not be accepted and deemed invalid.

24. If this Promotion or a particular entry period is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention, fraud or bad weather, the Promoter reserves the right, in its sole discretion and to the fullest extent permitted by law to:

(a) disqualify any Eligible Participant; or

(b) modify, suspend or reject an entry period the Promotion, as appropriate.

25. The Promoter reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of this Competition or to be acting in violation of these Terms and Conditions.


Promoter’s Decision

26. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on each person who enters this Competition and no correspondence will be entered into. Participants are responsible for any late, lost or misdirected Entries.

27. The Promoter reserves the right, at any time, to:

(a) verify the validity of Entries;

(b) verify the Eligible Participant’s personal details (including an Eligible Participant’s identity, age and place of residence); and

(c) disqualify any participant who attempts to enter or enters this Competition in a way that is not in accordance with these Terms and Conditions or who tampers with this Competition in any way.

28. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


Privacy

29. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, Australian regulatory authorities. Entry is conditional on providing this information. When entering this Promotion, you agree to receive emails about your Entry and your participation in the Promotion, as reasonably determined to be necessary for the operation of this Promotion by the Promoter in its absolute discretion.

30. Notwithstanding the above clause 31, the Promoter, its agents or service providers may contact the Eligible Participant in connection to the use of their Entry including any acceptance, rejection or use of the Entry for its purposes.


Liability

31. Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

32. This promotion is in no way endorsed, sponsored or affiliated with Facebook. Each participant agrees to indemnify Facebook against all costs and claims arising in connection with a failure by him/her to comply with these Terms and Conditions, or otherwise arising in connection with this Competition.

33. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.


Miscellaneous

35. If any provision of these Terms and Conditions is unenforceable for any reason, such provision shall be severed from these Terms and Conditions and the remaining Terms and Conditions will remain in full force and effect.

36. These terms and conditions are governed by the laws of New South Wales. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
