Terms and Conditions (Terms)
1. These terms and conditions govern the participation in this Canon Colour Challenge Competition (Competition). Information and instructions on how to participate form part of these Terms.
2. Participation in the Competition is deemed acceptance of these Terms.
3. This Competition starts at 9:00am AEST on 19 July 2025 and ends at 6:00pm AEST on 20 July 2025 (Competition Period
Eligibility
4. This Competition is only open to individuals who:
a. are ticket holders attending the FRMEFEST 2025 Event at Carriageworks in Sydney (FRMEFEST Event) during the Competition Period; and
b. are not employees, contractors, volunteers, or persons otherwise associated with the organisation or delivery of the FRMEFEST Event, including but not limited to event staff, Canon employees, and affiliated partners.
5. Participants under the age of 18 must have written consent from their parent or legal guardian to enter this Competition.
How to Enter
6. During the Competition Period (Competition Period), Canon will announce and promote the Competition through:
a. promotional materials displayed at the FRMEFEST Event; and
b. the official FRMEFEST Event app.
7. To enter this Competition, Participants must:
a. attend the FRMEFEST Event;
b. complete a valid game entry at the Canon Colour Challenge activation during event hours;
c. provide their names for verification purposes, valid email addresses, delivery addresses and any other the details requested in the activation prior to playing; and
d. participate in a timed colour-based challenge in which they must identify the odd colour out. Participants have 30 seconds per attempt, and the game ends immediately upon an incorrect answer, (collectively, an Entry).
8. There is no limit to the number of entries per Participant. However, they must rejoin the queue for each additional attempt.
9. A daily winner will be determined based on the highest score achieved on each competition day.
10. By entering this Competition, Participants consent to receiving marketing communications and promotional information from Canon regarding the latest Canon products, offers, and services. Participants may opt out of communications at any time.
Judging
11. This Competition is a game of skill. At 5:00pm AEST on 19 July and 20 July, Canon will select the Participant who achieves the highest score in the Canon Colour Challenge each day (Winner).
12. If there is a tie on either day, Canon will select the ultimate winner by entering the Participants with the top 2 scores into a random draw. The first Participant whose name is drawn in the random draw will be the Winner.
13. The scoreboard will reset at the end of each day
14. Canon’s decision is final, and no correspondence will be entered into.
15. No responsibility is accepted for any Entry that is late, lost, misdirected, or if a Winner does not claim their prize in accordance with these Terms.
Prizes
16. The total prize pool is valued at AUD $566.00
17. The Winner of each day will receive 1 x Canon SELPHY CP1500 printer and 1 x RP-108 Ink and Paper Pack, valued at AUD $283.00 (RRP) (Prize).
Claiming the Prize
18. Canon will announce the Winners each day of the Competition Period during the FRMEFEST Awards Ceremony at the FRMEFEST Event, subject to any directions from a regulatory authority.
19. If the Winners are at the FRMEFEST Event at that time, they may claim the Prize at the Awards Ceremony. If the Winners are not present on site, they will be notified in writing via email from Canon to the email address provided on their Entry form submission by 25 July 2025.
20. Winners must follow the instructions in Canon’s email on how to claim their Prize, including providing a valid address in Australia for their Prize to be delivered to.
Prize Processing:
21. Canon will send the Prize to the delivery address provided by the Winner via registered Australia Post.
22. Canon will send a tracking number to each Winner within 14 business days of sending the Prize, and the Winner agrees to acknowledge delivery of the Prize by signing an acknowledgement of receipt.
23. Canon has no control of and is not responsible for any delays or issues arising from the use of Australia Post.
24. If the Winner:
a. does not, within 14 days of being notified by Canon that they have won a Prize, claim their Prize according to the instructions specified in the Canon’s email (including by not providing a correct email address or valid delivery address for the Prize to be delivered to by the stated due date); or
b. cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Prize in its entirety.
25. If the Winner forfeits the Prize, the Promoter may award the Prize to the Entry with the second-highest score on the relevant day of the Competition Period at their sole discretion. If more than one Entry has the next highest score, Canon will select a Winner from those Entries in a random draw.
26. The Prize or any unused portion of a Prize is not exchangeable for cash or goods and is not transferrable. The Promoter will not compensate the Winner in any way for a Prize that has not been claimed within the time limits and in accordance with the instructions given to the Winner.
Participant’s Warranties and Indemnity
27. Canon is not liable for any costs and claims in connection with a failure by itself to comply with these Terms.
28. Each Participant agrees that they are fully responsible for each Entry they submit. To the fullest extent permitted by law, Canon excludes any liability and any costs borne by the Participant in submitting their Entry.
29. This Competition is in no way endorsed, sponsored or affiliated with FRMEFEST Group Pty Ltd. Canon is not liable for any costs and claims arising in connection with a failure by FRMEFEST Group Pty Ltd service provider to comply with these Terms, or otherwise arising in connection with this Competition.
Conditions that may Invalidate Entries, Participants or the Competition
30. Canon reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.
31. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by Canon, including but not limited to technical difficulties, unauthorised intervention or fraud, Canon reserves the right, in its sole discretion, to the fullest extent permitted by law to:
a. to disqualify any Participant; or
b. modify, suspend, terminate, or cancel the Competition as appropriate.
32. Canon reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.
33. Errors and omissions may be accepted at the Promoter's discretion. Failure by Canon to enforce any of its rights at any stage does not constitute a waiver of those rights.
Privacy
34. Canon collects personal information in order to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
35. Information about Participants may be published as set out in these Terms. Personal information collected by Canon will be managed in accordance with its Privacy Policy (www.canon.com.au/privacy-policy).
Liability
36. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (NonExcludable Guarantees).
37. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Canon (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under Canon’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Canon) due to any reason beyond the reasonable control of Canon; or (d) any tax liability incurred by a Participant.
General
38. These Terms may change, and Canon will inform Participants of any changes as soon as reasonably possible.
39. Canon will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.
40. All money amounts in these Terms are in Australian Dollars inclusive of GST.
41. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.
42. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
